ПОДОЛАННЯ ЮРИДИЧНИХ ПРОГАЛИН, ЯК КЛЮЧОВИЙ АСПЕКТ ВІДОМЧОГО ОСВІТНЬОГО НОРМОТВОРЕННЯ В СИСТЕМІ СУБ’ЄКТІВ СЕКТОРУ БЕЗПЕКИ ТА ОБОРОНИ УКРАЇНИ
Educational relations in the system of subjects of the security and defense sector of Ukraine are legal in nature and are within the scope of actual legal regulation. Security and educational relations today are partially regulated by national and interdepartmental regulations. Such prescriptions regulate a wide range of relationships that arise during the conduct of educational activities: from laying the basic legal, organizational, financial foundations of the functioning of the education system in the country in general, to the scientific and methodological and organizational foundations of creating and implementing an effective system of profile training of the individual subject the security and defense sector of Ukraine.
The article shows the issues of creation of legal norms in the educational sphere at the level of security and defense sector of Ukraine through an analysis of the theoretical foundations of search and overcoming legal gaps. Today the system of education specialists in the security and defense sector of Ukraine is undergoing significant changes – new social and political factors affect the nature, components and process of formation of relevant competences. Transformation of the content of education (formation of advanced knowledge and practical skills) of employees of departments leads to change of organizational and legal principles of education. This is achieved through the search for and elimination of legal loopholes. Elimination of gaps in the educational law of departments is based on the theory of rulemaking: classic signs of legal gaps, causes, means and ways of overcoming them.
The need to shape the competencies of a specialist of the department is a local issue, and its regulation depends on many factors, so the basic way to overcome the gaps in the educational law of the department is to create new sources of law.
