ESSENCE, LEVELS AND COMPONENTS OF CONTROL AND SUPERVISORY ACTIVITIES IN THE SPHERE OF OVERUSE
Abstract
The article is devoted to the formation of new scientific solutions regarding the definition of the essence, levels, and components of control and supervision activities in subsoil use (CSAFSU). In work, based on the implementation of the decomposition method of system analysis and tuple recording, the essence of the concept of “control and supervision activity in the field of subsoil use” is determined. At the same time, the nature of the terms “control,” “supervision,” “activity,” “control and supervision activity,” and “subsoil use” is consistently defined. Three levels of control and supervision activities in the field of subsoil use (macro-, meso-, micro-) are also described. Two sub-levels are distinguished at the macro- and meso-level of the CSAFSU: for the macro-level – world and international level; for the meso level (state level) – state and non-state (public) levels. The micro-level of control and supervision activities in the field of subsoil use is represented by the CSAFSU at the level of individual business entities. Each of the defined levels (sublevels) is characterized in terms of determining the purpose, tasks, subjects and objects of control and supervision activities in the field of subsoil use. It has been proven that the meso level (the level of a separate state) is the crucial level of the CSAFSU, and it is the state control and supervision activity in the field of subsoil use. The components of the state CSAFSU for Ukraine were disclosed, where special attention was paid to the construction of the hierarchical structure of subjects of state control and supervision activities in the field of subsoil use. It is emphasized that the hierarchical structure of the subjects of the state CSAFSU in Ukraine includes five levels, where the top three levels refer to the control and supervision of the country’s subsoil by state power institutions and institutions of judicial power. The two lower levels are related to the competence of local government bodies and relevant judicial authorities.
