The practice of its application is gradually beginning to take shape, gaps in legal regulation are emerging, and doctrinal provisions are being developed. A significant difference between the new Criminal Procedure Code is that it is based on the ideology of the rule of law, the unconditional priority of such universal values ​​as freedom and personal integrity, respect for human dignity. The general principles of criminal proceedings proclaim legality, equality before the law and the court, the presumption of innocence, ensuring the right to defense, access to justice, adversarial parties and freedom to present their evidence to the court and to prove their persuasiveness before the court and others. This, of course, increases the significance of this legislative act, the level of protection of a person who falls into the sphere of criminal proceedings. In addition, the 2012 Code of Criminal Procedure set strict requirements for the admissibility of evidence, according to which any evidence obtained in violation of the procedure provided for in the Code of Criminal Procedure, as a result of a substantial violation of human rights and freedoms, is inadmissible and cannot be used. procedural decisions, it cannot be referred to by the court when making a court decision. Thus, the conduct of investigative actions, which are the main way of gathering evidence in criminal proceedings, significantly increases the requirements of the legality of their conduct, respect for the rights and legitimate interests not only of those involved but also those whose rights and legitimate interests may be or violated during their conduct.
